Terms of Service

1. Acceptance of Terms

Welcome to OptiLM, operated by Mattia Campione, creator and operator of the Optifusion / OptiLM project ("Operator," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the OptiLM website located at optilm.com, including all content, features, and services offered (collectively, the "Service").

These Terms constitute a legally binding agreement between you and Mattia Campione as the Operator. Please read them carefully before using our Service.

Optifusion is currently the project/brand name used by Mattia Campione, not a separately registered company. This page does not state that a business registration or VAT registration has been completed.

2. Eligibility

To use OptiLM, you must:

• Be at least 18 years old and meet any higher age requirement applicable to entering this agreement in your jurisdiction
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable laws
• Not have been previously banned or removed from the Service

OptiLM is an adults-only service. You must give your correct date of birth and confirm that you are at least 18 when registering. Existing accounts and accounts using Google sign-in must complete the declaration before using restricted features or starting a paid subscription. This declaration is not identity verification. Do not use someone else's account, supply a false date or help a minor bypass this requirement. Account management, support and billing cancellation remain available if eligibility needs to be resolved.

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. Account Registration

3.1 Account Creation

To access certain features of the Service, you must register for an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

3.2 Account Security

You are responsible for maintaining the security of your account credentials. We recommend:

• Using a strong, unique password
• Not sharing your account with others
• Logging out after each session on shared devices

3.3 Account Termination

You may delete your account at any time through your account settings. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Description of Service

OptiLM provides the following features:

• AI Chat: An interface to interact with artificial intelligence models for conversation, questions, files, images, planning, and assistance.
• Prism Canvas: A paid visual learning workspace with explanations, editable boards, generated images and bounded voice turns.
• Software: A catalogue of desktop programs when releases are published, with platform requirements and licence information for each download.
• Notebook: A community writing area where signed-in users may create, edit, publish, and share posts.
• Research: An admin-published area for innovation-focused posts about AI architecture, LLM improvements, robotics, intelligence, science, and related topics. Signed-in users may comment.
• Leaderboards and Debate: Ranking, debate, and community evaluation systems.
• Predictions and Tools: Prediction analysis, food and diet tools, dog breed browsing, games, simulations, and other practical or experimental features.
• Feedback: A system for submitting feedback and suggestions.

The Service is provided "as is" and may be modified, updated, or discontinued at any time without prior notice.

4.1 Prism Models and Reasoning Effort

Prism-1 and Prism-2 are services that coordinate third-party AI models. When Prism-2 is enabled, active paid plans can choose between the versions, subject to their plan's available efforts and allowances. The free Slate plan provides Prism-1 access. Swift, Balanced, Advanced, and their available plus levels offer different combinations of model capability, processing time, and usage. Auto uses request characteristics, capability requirements and available allowance to select an eligible model arrangement and effort within your plan. It may choose a different arrangement for a different task; you can choose an effort manually. A route is an estimate of suitability, not a guarantee of model accuracy.

4.2 Saved Chats, Temporary Chats, and Stop

Saved chat text and response status can synchronize between tabs and devices signed in to the same account. Synchronization depends on connectivity; attachments are not saved in synchronized history. Temporary chats keep their conversation archive in browser memory, do not become saved conversations, and do not use or update personalization. Requests still send conversation text to our servers for context selection and short-lived processing, and selected context to our AI providers, as described in the Privacy Policy.

Where offered, you can send clarifications while Prism-2 is working. Accepted clarifications are applied between processing stages; a provider call already in progress may finish before a clarification takes effect. Once the server confirms Stop, it suppresses publication of that unfinished answer across your signed-in devices. Stop does not retract data already sent to providers or necessarily halt their work immediately. Processing already started may count toward your usage allowance. Continue creates a new, metered attempt using the stopped request; it does not resume the provider computation at its exact stopping point. Stopped requests are available to continue for up to one hour, unless deleted or superseded by another turn.

4.3 Prism Canvas and Generated Media

Canvas is available on active paid plans. It can arrange explanations, diagrams, charts, formulas and generated images on a saved whiteboard. Voice is offered as bounded record-and-reply turns, with AI-generated playback, rather than an uninterrupted live call. Generated charts and explanations can contain errors; illustrative values must not be treated as observed facts. The service supports learning and does not guarantee educational outcomes or replace a qualified teacher or professional advice. Image quality follows the selected effort. Images, voice and longer explanations can use a significant part of the weekly allowance, and a request can be declined when its reservation cannot fit.

4.4 Conversation Archives and Recall

To fit a model's context budget, the Service selects recent conversation turns and relevant older verbatim excerpts. This process preserves the original saved message text and does not replace it with an AI-generated summary or make an extra AI summarization call. You can use Search chats and Copy to inspect and reuse the original saved text. Conversation storage and processing remain subject to size and plan limits.

The AI does not receive the entire archive on every request. Selection can omit relevant details, and the AI can misremember or misquote even text it receives. No perfect or unlimited recall is promised. When exact wording matters, consult or copy the saved message directly rather than relying on a generated quotation.

4.5 Downloadable Software

A catalogue listing is available to download only when a release has been published. Each program identifies its supported platform, version and applicable licence. Installing a program is a separate action under that licence and any product-specific privacy information. A website subscription does not include a software licence or continuing software support unless the relevant offer expressly says so. Review system requirements, permissions and release notes before installing; a file checksum confirms file integrity and is not a guarantee of security.

Individual releases may be public, require an account, or require an eligible active paid plan. These conditions are displayed with the program. Access is checked again when a protected installer or update is requested. A future desktop app may check the release catalogue for updates; availability of update metadata does not mean an in-app installer or automatic update feature has already been released. Any automatic installation behavior and the scope of continuing use after a subscription ends must be stated in that program’s licence and interface.

4.6 Maps and Planned Products

Maps currently provides an interactive map, a limited local place list, coordinates and links to external directions services. It does not provide its own turn-by-turn navigation, live traffic or emergency routing. Map data can be incomplete or out of date. Respect OpenStreetMap attribution and the applicable data licence. The 3D and Government pages describe future directions; they do not promise a released editor, government partnership or delivery date.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

5.1 Prohibited Content

• Submit, upload, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Generate content that promotes violence, discrimination, or hatred against individuals or groups
• Create or distribute child sexual abuse material (CSAM) or content sexualizing minors
• Share content that infringes on intellectual property rights
• Post spam, repeated low-quality comments, or content intended to manipulate rankings, recommendations, comments, or community systems
• Distribute malware, viruses, or other harmful code
• Engage in phishing or fraudulent activities

5.2 Prohibited Activities

• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service or servers
• Use automated systems (bots, scrapers) without permission
• Circumvent rate limits or security measures
• Impersonate any person or entity
• Collect or harvest user data without consent
• Resell access to the Service, misrepresent your affiliation with OptiLM, or use third-party material without the rights required for that use
• Attempt to gain unauthorized access to the Service; this does not limit rights to inspect, interoperate with or modify downloaded software where its licence or applicable law permits

6. AI Service Disclaimer

6.1 Nature of AI Responses

The AI chat feature uses third-party artificial intelligence models. You acknowledge and agree that:

• AI responses are generated by machine learning models and may be inaccurate, incomplete, or misleading
• AI does not have personal opinions, feelings, or consciousness
• AI responses should not be considered professional advice (medical, legal, financial, etc.)
• Food, diet, prediction, debate, and research outputs are informational and should not be treated as professional, medical, financial, legal, or safety-critical advice
• You should independently verify any important information provided by the AI

6.2 No Guarantee of Accuracy

We do not guarantee the accuracy, completeness, reliability, or suitability of AI-generated content. The AI may:

• Produce factually incorrect information ("hallucinations")
• Provide outdated information
• Generate biased or inappropriate responses despite our best efforts
• Fail to understand context or nuance

6.3 Not a Substitute for Professional Advice

6.4 Prism-2 Limitations

File support depends on the format, selected effort, plan limits, and whether readable content can be extracted. PDF and Office text conversion can omit images, charts, layout, and other elements; spreadsheet formulas are not recalculated. Scanned or encrypted documents and unsupported binary formats may need a different export. Do not assume an attachment was fully interpreted merely because it was accepted. Keep your original files and use page images when visual details matter.

Prism-2 combines independent drafts and, at higher efforts, an additional review before synthesis. Agreement between models, a higher effort, or a newer version does not guarantee a correct answer or better results on every task. If a provider fails, the Service may return a completed answer from one model with a notice that fusion was unavailable, or report that the request could not be completed. Progress labels describe processing stages; they are not a transcript of a model's private reasoning.

This Prism-2 release does not browse the web, run code, control your computer, or take actions in external services. An answer containing a link or proposed action is not evidence that Prism-2 visited that link or performed the action. References and time-sensitive claims require independent verification. Web search available in another OptiLM feature does not mean it is available in Prism-2.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its original content, features, functionality, design, and branding, is owned by the Operator or its respective rights holders and is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Remove any copyright or proprietary notices

7.2 Generated Content

Subject to applicable law and the rights of others, you may use text, code, diagrams and images produced for you, including for commercial purposes. Generated content may not be unique or eligible for copyright protection, and we do not guarantee that it is free of third-party rights. Review outputs before publication, preserve any required third-party notices and do not present an AI-generated image or voice as a genuine recording where that would mislead people.

7.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without any obligation to compensate you.

8. User Content

8.1 Ownership

You retain ownership of any content you create or submit through the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely for the purpose of providing the Service.

8.2 Public Posting

If you publish Notebook posts or submit comments, you understand that those posts, comments, usernames, tags, excerpts, and related metadata may be visible to other users or visitors. Do not publish private, confidential, or sensitive information that you do not want others to see.

8.3 Responsibility

You are solely responsible for your User Content and the consequences of posting or sharing it. You represent that:

• You own or have the necessary rights to your User Content
• Your User Content does not infringe on third-party rights
• Your User Content complies with these Terms and applicable laws

8.4 Research Editorial Control

Research posts are controlled by the authorized OptiLM administrator. Users may comment where commenting is available, but they do not have a right to publish Research posts or require us to publish, keep, or promote any particular research submission.

8.5 Removal

We reserve the right to remove, hide, delete, or limit any User Content that violates these Terms, creates legal or safety risk, harms the community, or that we otherwise find inappropriate for the Service.

9. Subscriptions and Billing

9.1 Subscription Plans

OptiLM offers tiered subscription plans (Slate, Amber, Obsidian, and Diamond) that provide varying levels of access to AI-powered features. Plan details, pricing, and included features are described on our Pricing page and may be updated from time to time.

9.2 Payment Processing

All payments are processed securely through Stripe, Inc. ("Stripe"). By subscribing to a paid plan, you authorize Stripe to charge your selected payment method on a recurring monthly basis. You agree to provide accurate and complete billing information and to keep it up to date.

9.3 Billing Cycle

Subscriptions are billed monthly starting from the date of your initial subscription. Your payment method will be charged automatically at the beginning of each billing period. If your payment fails, we may suspend your access to paid features until payment is resolved.

9.4 Upgrading and Downgrading

You may change your subscription plan at any time. When upgrading, you will be charged the prorated difference for the remainder of your current billing period. When downgrading, the change takes effect at the end of your current billing period, and you will retain access to your current plan until then.

9.5 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to your paid plan features until the end of your current billing period. After that, your account will revert to the free Slate plan. Except where applicable law or these Terms provide otherwise, cancellation does not create an automatic partial refund for an unused billing period.

9.6 Refund Policy

Your mandatory consumer rights remain unaffected, including any applicable withdrawal right and remedies for a digital service that does not conform to its contract. Subject to those rights, we also consider discretionary refund requests for:

• Technical issues that prevented you from using the Service for a significant portion of your billing period
• Accidental duplicate charges
• Unauthorized transactions (subject to verification)

Contact legal@optilm.com to request a refund or exercise a withdrawal right. Please raise discretionary requests within 14 days of the charge; this does not shorten a statutory deadline. Starting to use the Service is not, by itself, treated as a waiver of any mandatory withdrawal right. Any legally required express request, acknowledgement or payment for services already supplied is handled under the applicable law. Approved or legally required refunds are processed through Stripe to the original payment method where possible.

9.7 Price Changes

We reserve the right to change subscription prices. If we change pricing, we will provide at least 30 days' notice before the new price takes effect. Your continued subscription after the price change constitutes acceptance of the new pricing. If you do not agree, you may cancel your subscription before the new pricing takes effect.

9.8 Usage Limits

Each subscription tier includes weekly chat allowances and per-effort message ceilings, context windows, model access, feature access, and other usage caps as described on the Pricing page or inside the Service. These limits are designed so the Service can remain financially sustainable and may be adjusted to prevent abuse, fraud, excessive cost, or negative-margin usage. Attempting to circumvent usage limits through multiple accounts, automation, account sharing, or other means is a violation of these Terms.

Prism-1, Prism-2, Canvas, generated images and voice share a weekly credit allowance included in your subscription. It resets Monday at 00:00 UTC, with your local reset time shown in Settings. Per-effort message caps apply in addition to credits. Other AI tools can retain their separately displayed limits. Higher efforts generally use more provider resources, and longer conversations or attachments can also use more of the allowance. A request may be unavailable even if message counts remain, because its estimated processing cannot fit the remaining allowance. Starting a request reserves estimated usage; stopped or failed requests may still use the allowance when provider processing has already begun. These allowances are access controls, not a cash balance or additional fees, and Prism-2 does not automatically charge overage payments. Your subscription price is unchanged unless you agree to a plan change or a notified price change under these Terms.

10. Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains the purposes and legal bases for processing; it is not a blanket consent request.

11. Third-Party Services

The Service may integrate with or link to third-party services, including:

• AI infrastructure providers (Anthropic, OpenAI and Google where enabled, according to the selected feature and effort)
• Payment processor (Stripe)
• Font providers (Google Fonts)
• External websites linked from our content

We are not responsible for the content, privacy policies, or practices of third-party services. Your use of third-party services is at your own risk and subject to their respective terms and policies.

12. Disclaimers

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of any information obtained through the Service
• Warranties that the Service will meet your requirements or expectations

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• the Operator and people acting on the Operator’s behalf shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater
• We are not liable for any damages resulting from:
  • Your use or inability to use the Service
  • Unauthorized access to your data
  • Conduct of third parties on the Service
  • AI-generated content or responses
  • Service interruptions or data loss

These exclusions and limits apply only to the extent lawful. They do not exclude mandatory consumer remedies or liability that cannot legally be limited, including liability for fraud, wilful misconduct or gross negligence where applicable. Any mandatory protection under the law of your habitual residence remains available.

14. Indemnification

You agree to indemnify, defend, and hold harmless the Operator and people acting on the Operator’s behalf from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

15. Termination

15.1 Termination by You

You may terminate your account at any time by deleting it through your account settings or by contacting us.

15.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

15.3 Effect of Termination

Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and User Content
• Provisions of these Terms that should survive termination will remain in effect

16. Modifications to Service

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time
• Change features, functionality, or content without notice
• Impose limits on certain features or restrict access to parts of the Service

We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

17. Governing Law

These Terms are governed by Italian law, without depriving consumers of mandatory protections under the law applicable in their country of habitual residence. The courts with jurisdiction are determined by applicable law, including any protected consumer forum; these Terms do not require a consumer to bring a claim exclusively in Italy.

18. Dispute Resolution

18.1 Informal Resolution

Please contact legal@optilm.com so we can try to resolve a complaint. This invitation does not prevent you from contacting a regulator, using an available dispute-resolution procedure or taking legal action within applicable deadlines.

18.2 Formal Resolution

If a complaint remains unresolved, either party may use the courts or another procedure available under applicable law. Arbitration is not compulsory under these Terms. Any voluntary alternative dispute-resolution arrangement must preserve mandatory consumer rights.

18.3 Collective and Regulatory Rights

These Terms do not waive any non-waivable right to collective redress, representative action or a complaint to a competent authority.

19. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top of these Terms
• For material changes, we will provide notice through the Service or via email
• Your continued use of the Service after changes constitutes acceptance of the new Terms

If you do not agree to the modified Terms, you must stop using the Service and delete your account.

20. Contact Information
